These Terms & Conditions (“Terms”, “Terms and Conditions” or “Agreement”) govern your access to and use of Filmkar.com, including its website, sub-domains, mobile applications, digital services, features, tools, AI-enabled services, communication features, talent profiles, project listings, audition listings and other services made available through the platform (collectively, the “Platform”).
By accessing, browsing, registering on, or using Filmkar.com, you acknowledge that you have read, understood and agreed to be bound by these Terms, together with our Privacy Policy, Community Guidelines, AI Usage Policy, Cookie Policy, and any other policies or guidelines published on the Platform from time to time.
If you do not agree with these Terms, please do not access or use the Platform.
Filmkar.com is an AI-integrated online networking platform for filmmakers, creative professionals, talent, and entertainment industry professionals.
Filmkar is designed to facilitate professional networking, digital portfolios, talent discovery, project discovery, auditions, casting opportunities, industry information and communication between members of the filmmaking and entertainment ecosystem.
The Platform may use Artificial Intelligence and machine-learning technologies to support features such as profile organisation, search, recommendations, talent discovery, opportunity matching, content assistance, personalisation and other platform functions.
Filmkar is a technology platform and does not, unless expressly stated otherwise for a particular service, act as an employer, talent agent, casting agency, production house, manager, or representative of any user.
For the purpose of these Terms:
means Filmkar.com and the entity legally owning and/or operating the Platform, together with its affiliates, employees, representatives, contractors and authorised service providers, as applicable.

means any individual or organisation accessing or using the Platform.
means individuals or professionals who create profiles to showcase their skills, experience, portfolios, work, services or professional information.
Talent may include, without limitation, actors, directors, writers, cinematographers, editors, musicians, singers, dancers, models, photographers, production professionals, technicians, designers, anchors, choreographers and other creative professionals.
means a production house, casting professional, casting agency, modelling agency, advertising agency, producer, director, event company, media organisation, filmmaker, company, individual or other person seeking talent, collaborators or services.
means any information, text, photograph, video, audio, portfolio, document, profile information, project information, comments, messages or other material uploaded, submitted, posted or otherwise made available by a User.
means any feature, tool, functionality or service on Filmkar that uses Artificial Intelligence, machine learning, automated processing, recommendation systems, generative AI or related technologies.
means Filmkar.com and all associated websites, applications, software, interfaces, services and digital features operated by or on behalf of Filmkar.
You must be at least 18 years of age, or the minimum legal age required to enter into a binding contract in your jurisdiction, to create and operate an account on Filmkar, unless applicable law permits otherwise.
If a minor is permitted to have a profile on the Platform, such profile must be created, managed or authorised by a parent or legal guardian in accordance with applicable law and Filmkar's policies.
By registering, you represent that:
the information provided by you is accurate and complete;
you have the legal capacity to enter into these Terms;
you will maintain accurate and updated account information; and
you will comply with applicable laws and these Terms.
Certain features of Filmkar may require registration.
When creating an account, you agree to provide accurate, complete and current information.
You are responsible for:
maintaining the confidentiality of your login credentials;
all activity occurring through your account;
updating inaccurate or outdated information; and
notifying Filmkar promptly if you suspect unauthorised access to your account.
You must not:
impersonate another person;
create an account using another person's identity without authorisation;
create multiple accounts for deceptive or abusive purposes;
sell, transfer or otherwise misuse your account; or
provide false professional credentials or experience.
Filmkar may suspend, restrict or terminate accounts that violate these Terms or applicable law.
Filmkar allows Users to create professional digital profiles.
Users are solely responsible for the accuracy, legality and authenticity of information displayed on their profiles.
A profile may contain photographs, videos, professional credits, skills, education, experience, portfolio materials, links and other information submitted by the User.
Users must ensure that they have the necessary rights, permissions and consents to upload and display all material included in their profiles.
Filmkar does not guarantee that a profile will result in auditions, employment, projects, bookings, representation, financial benefit, career advancement or any other particular outcome.
Filmkar may provide eligible Users with a dedicated profile URL.
The profile URL may be used by the User as a professional digital portfolio or networking link.
Filmkar reserves the right to:
change the format of profile URLs;
suspend or deactivate URLs associated with inactive or terminated accounts;
reclaim URLs where reasonably necessary; and
remove URLs that violate these Terms or applicable law.
Users must not use profile URLs for fraudulent, unlawful, misleading or abusive purposes.
Filmkar may provide networking and communication tools that enable Users to connect with other members.
Users are solely responsible for their interactions and communications with other Users.
Users must communicate professionally and must not use Filmkar to:
harass, threaten, stalk or intimidate another person;
send spam or unsolicited commercial communications;
distribute malware or malicious content;
engage in fraud or deception;
solicit illegal activities;
distribute sexually explicit or exploitative material;
collect personal information without appropriate authority;
circumvent Filmkar's safety or communication controls; or
engage in any activity prohibited by applicable law.
Filmkar may restrict or suspend communication privileges where misuse is detected or reported.
Filmkar may provide information about auditions, casting calls, filmmaking projects, employment opportunities, collaborations, events and other opportunities.
Unless expressly stated otherwise, Filmkar acts as a technology platform facilitating discovery and connection between Users.
The information relating to an opportunity may be submitted by a third party.
Filmkar does not guarantee that:
an opportunity is genuine or suitable for every User;
a recruiter will respond;
an audition will take place as described;
a project will be completed;
a User will be selected;
a User will receive payment; or
an opportunity will result in employment or professional engagement.
Users should independently verify important information before entering into any professional, financial or contractual relationship with another User.
Recruiters may use Filmkar to discover and evaluate professional profiles and connect with potential talent.
Recruiters are solely responsible for:
the accuracy of their project information;
the legitimacy of their organisation or project;
their communications with talent;
contractual arrangements with talent;
payment obligations;
applicable labour, tax and regulatory requirements; and
obtaining all required permissions, licences and consents.
Recruiters must not use Filmkar to discriminate unlawfully, deceive applicants, collect information for unauthorised purposes, or publish fraudulent opportunities.
Filmkar does not guarantee the conduct, financial capacity, legitimacy or professional performance of any recruiter or talent unless expressly verified and represented by Filmkar.
You retain ownership of the User Content that you submit to Filmkar, subject to the rights and licences granted under these Terms.
By uploading or submitting User Content, you represent and warrant that:
you own the content or have all necessary rights and permissions to use it;
the content does not infringe another person's intellectual property, privacy, publicity or other rights;
you have obtained required permissions from identifiable persons appearing in the content, where applicable;
the content is not unlawful, defamatory, fraudulent or misleading; and
the content complies with these Terms and applicable law.
By submitting User Content to the Platform, you grant Filmkar a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, transmit, distribute and technically process that content for the purpose of operating, maintaining, improving and providing the Platform and its services.
This may include:
displaying your profile;
enabling discovery by other Users;
generating search results;
providing recommendations;
creating previews or thumbnails;
improving Platform functionality;
maintaining security and moderation systems; and
communicating Platform-related information.
Filmkar will not acquire ownership of your original User Content merely because you upload it.
The licence will continue for as long as reasonably necessary to provide the relevant service and thereafter to the extent necessary for legitimate business, legal, security, backup or archival purposes, subject to applicable law and our Privacy Policy.
Filmkar is an AI-integrated platform.
Artificial Intelligence may be incorporated into different aspects of the Platform, including but not limited to:
talent discovery;
profile analysis and organisation;
search and filtering;
opportunity recommendations;
talent-opportunity matching;
content assistance;
personalised recommendations;
automated categorisation;
moderation and safety;
fraud and abuse detection;
platform optimisation; and
other current or future features.
The exact AI features available may change as Filmkar develops its Platform.
AI-generated or AI-assisted recommendations, classifications, matches, summaries or other outputs may contain inaccuracies, omissions or errors.
AI outputs should therefore be treated as assistance and recommendations, not as guaranteed facts, professional advice, employment decisions or representations by Filmkar.
Users remain responsible for independently evaluating information before relying on it.
Filmkar does not guarantee that AI-generated or AI-assisted results will always be:
accurate;
complete;
unbiased;
current;
suitable for a particular purpose;
free from errors; or
free from false positives or false negatives.
Where AI features process User Content, such processing will be governed by these Terms and the Filmkar Privacy Policy.
Users should not upload confidential, sensitive or third-party information unless they have the necessary authority to do so.
Where Filmkar provides generative AI features, Users remain responsible for reviewing and verifying AI-generated material before publishing, submitting, commercialising or otherwise using it.
Users must not use Filmkar's AI features to generate, manipulate or distribute content for unlawful, fraudulent, defamatory, deceptive, abusive or infringing purposes.
Where applicable law or Platform policy requires disclosure of AI-generated or synthetically altered content, Users must comply with such requirements.
Filmkar may introduce additional AI-specific rules as technology and applicable law evolve.
You must not use Filmkar to upload, publish, transmit or distribute content that:
is unlawful or promotes unlawful activity;
infringes intellectual property rights;
impersonates another person or organisation;
is fraudulent or deliberately misleading;
contains malware or malicious code;
constitutes harassment, threats or stalking;
promotes violence or exploitation;
contains non-consensual intimate material;
exploits or endangers children;
violates another person's privacy;
contains unauthorised personal information;
promotes scams or fraudulent auditions;
falsely claims association with Filmkar;
attempts to manipulate ratings, recommendations or Platform systems; or
otherwise violates applicable law or these Terms.
Filmkar may remove, restrict or disable access to content that it reasonably believes violates these provisions.
All intellectual property relating to the Filmkar Platform, including its:
name;
trademarks;
logos;
branding;
software;
website design;
user interface;
databases;
graphics;
text;
original content;
technology;
AI systems;
algorithms;
Platform architecture; and
other proprietary materials
is owned by, licensed to, or otherwise lawfully used by Filmkar and is protected by applicable intellectual property laws.
Except as expressly permitted by Filmkar, Users may not:
copy;
reproduce;
modify;
distribute;
sell;
license;
reverse engineer;
decompile;
scrape;
commercially exploit; or
create derivative works from
the Platform or its proprietary content.
Filmkar respects the intellectual property rights of Users and third parties.

Unless expressly stated otherwise, payment for a Filmkar service does not guarantee employment, selection, casting, auditions, bookings, projects, followers, visibility or any particular professional outcome.
Where Filmkar offers subscription-based services, the applicable subscription terms will be displayed at the time of purchase.
Users are responsible for reviewing:
subscription pricing;
billing frequency;
renewal terms;
cancellation requirements; and
applicable refund conditions
before subscribing.
Filmkar may modify subscription plans or pricing in accordance with applicable law and reasonable notice requirements.
Refunds, where applicable, will be governed by Filmkar's applicable Cancellation and Refund Policy.
Filmkar may suspend or terminate an account where a User:
violates these Terms;
provides false information;
engages in fraud or abuse;
infringes intellectual property;
compromises Platform security;
misuses AI features;
engages in harassment or unlawful conduct; or
otherwise creates a risk to Filmkar, its Users or third parties.
Where required by law, Filmkar will provide appropriate notice or process before termination.
Filmkar aims to maintain reliable Platform availability but does not guarantee that the Platform will always be:
available;
uninterrupted;
error-free;
secure;
compatible with every device; or
free from technical failures.
The Platform may occasionally be unavailable because of:
maintenance;
upgrades;
technical failures;
cybersecurity incidents;
telecommunications failures;
third-party service interruptions; or
circumstances beyond Filmkar's reasonable control.
Filmkar is intended to facilitate networking, discovery and access to opportunities.
However, Filmkar does not guarantee that use of the Platform will result in:
auditions;
casting;
employment;
contracts;
bookings;
representation;
income;
followers;
professional recognition;
career advancement; or
any other particular result.
Professional outcomes depend on numerous factors beyond Filmkar's control.
Filmkar may introduce or facilitate connections between Users.
However, any agreement, employment relationship, collaboration, payment arrangement, project engagement or other relationship formed between Users is generally between those Users.
Users are responsible for conducting their own due diligence before entering into professional or financial relationships.
Filmkar is not responsible for disputes arising from independent agreements between Users unless otherwise expressly agreed by Filmkar.
Filmkar may introduce measures to identify suspicious activity, fraudulent profiles, misleading opportunities, abuse, spam or other Platform risks.
Users should exercise caution when:
being asked for money by another User;
being asked to share sensitive personal information;
being offered unusually attractive opportunities;
being asked to communicate outside the Platform;
being asked to attend an unfamiliar location; or
receiving requests that appear suspicious.
Filmkar may suspend, restrict or remove accounts or listings associated with suspected fraudulent or harmful activity.
You must not use automated systems, bots, crawlers, spiders, scrapers, scripts or other technologies to:
scrape User profiles;
harvest personal information;
copy Platform databases;
reproduce Platform content;
bypass access controls;
circumvent technical restrictions; or
conduct unauthorised data mining.
You must not attempt to reverse engineer or extract Filmkar's proprietary algorithms, AI systems, models or Platform architecture except where expressly permitted by applicable law.
Where Filmkar provides reviews, ratings or recommendation features, Users must provide genuine and honest information based on their actual experience.
Users must not:
create fake reviews;
manipulate ratings;
review themselves;
review competitors deceptively;
purchase or sell reviews;
threaten another User to obtain a review; or
use reviews to harass or defame another person.
Filmkar may remove reviews or ratings that violate Platform policies.
Filmkar may display advertisements, sponsored content, promotional material or commercial communications on the Platform.
Users may also be permitted to promote legitimate professional services subject to Filmkar's policies.
Unauthorised mass advertising, spam, solicitation or commercial exploitation of Platform communication features is prohibited.
Filmkar may modify, improve, add, suspend or discontinue any feature, service, technology, category or functionality of the Platform.
This may include changes to:
AI features;
search functionality;
profile features;
recommendation systems;
subscription plans;
communication tools;
project listings;
auditions;
networking features; and
other Platform services.
Where required by applicable law, material changes will be communicated appropriately.
Filmkar may update these Terms from time to time.
The updated version will be published on the Platform with a revised “Last Updated” date.
Your continued use of Filmkar after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
Users should periodically review these Terms.
To the fullest extent permitted by applicable law, Filmkar provides the Platform on an “as is” and “as available” basis.
Filmkar does not warrant that:
information on the Platform will always be accurate or complete;
AI-generated results will always be accurate;
profiles or opportunities will always be genuine;
the Platform will always be available;
the Platform will meet every User's requirements;
every connection will result in an opportunity; or
the Platform will be free from technical errors or interruptions.
Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.
To the fullest extent permitted by applicable law, Filmkar shall not be liable for indirect, incidental, consequential, special or punitive losses arising from:
use or inability to use the Platform;
interactions between Users;
third-party conduct;
loss of business or opportunity;
loss of data;
unauthorised access;
reliance on AI-generated information;
third-party services;
professional decisions made based on Platform information; or
disputes between Users.
Nothing in these Terms shall exclude or limit liability that cannot legally be excluded or limited under applicable law.
To the extent permitted by applicable law, you agree to indemnify and hold harmless Filmkar, its directors, officers, employees, representatives, affiliates, contractors and service providers from claims, losses, liabilities, damages and reasonable expenses arising from:
your breach of these Terms;
your User Content;
your violation of applicable law;
your infringement of third-party rights;
misuse of the Platform;
misuse of AI features; or
your interactions or agreements with other Users.
Filmkar shall not be responsible for failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control.
Such circumstances may include natural disasters, epidemics, war, terrorism, civil unrest, government actions, internet or telecommunications failures, cybersecurity incidents, infrastructure failures, power outages, labour disputes, or failures of third-party service providers.
Filmkar is committed to providing an appropriate mechanism for Users to raise complaints relating to Platform content, account issues, privacy concerns, misuse, harassment, infringement or other matters.

Users must comply with all laws and regulations applicable to their use of Filmkar.

These Terms should be read together with applicable Indian laws and regulations governing online platforms, information technology, intellectual property, privacy, consumer protection and other relevant matters.
These Terms shall be governed by and interpreted in accordance with the laws of India.
Subject to applicable law, courts having competent jurisdiction in Bengaluru, Karnataka, India, shall have jurisdiction over disputes arising from or relating to these Terms or the use of Filmkar.
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be interpreted to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy and other policies expressly incorporated into them, constitute the agreement between you and Filmkar regarding your use of the Platform, unless a separate written agreement applies to a particular Filmkar service.
